1. Introduction

These Terms and Conditions ("Terms") form a legally binding agreement between you (the "User") and Faculti Media Limited ("we," "our," or "us") concerning your use of our services provided through the website lumiralearning.com, golumira.com, and any associated mobile applications (iOS and Android), collectively referred to as the "Platform."

Lumira is a trading name of Faculti Media Limited, registered in England and Wales under company number 08403116, with its registered office at Office One Coldbath Square, Farringdon, London, England, EC1R 5HL.

By accessing or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not access or use the Platform.

2. Description of Services

Lumira is an online tutoring platform connecting qualified UK tutors with students and families globally. The Platform provides live tutoring sessions via Zoom, AI-enhanced learning tools, notes, assessments, progress tracking, and associated educational features via web and mobile devices.

3. Eligibility and Registration

You must be at least 16 years old to register and use the Platform. Where a student is under 16, a parent or legal guardian must register on their behalf and accept these Terms. By registering or using our services, you warrant that:

  • You are legally capable of entering into a binding contract.
  • All information you provide is accurate, up to date, and complete.

You agree to keep your account credentials secure and accept responsibility for all activities that occur under your account. If you believe your account has been compromised, notify us immediately at info@lumiralearning.com.

4. Account Suspension and Termination

We may, without notice and at our sole discretion, suspend, restrict, or terminate your account or access to any part of the Platform for any reason, including violation of these Terms, suspected fraudulent activity, or legal/regulatory requirements.

5. Intellectual Property Rights

All intellectual property rights in the Platform and its content — including text, video, software, design, graphics, and branding — are owned by Faculti Media Limited or its licensors. You may not reproduce, transmit, republish, distribute, or exploit any part of the Platform without prior written consent.

You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial use only.

6. Use of Artificial Intelligence

Lumira uses AI technologies to enhance learning, including AI-powered revision, assessment generation, and tutor support tools. AI-generated content is informational and supplementary only and does not constitute professional academic advice. Users should verify information through additional sources before relying on AI-generated content.

7. Tutoring Sessions

Tutoring sessions are delivered live via Zoom by qualified UK tutors. Lumira facilitates the connection between tutors and students but is not responsible for the specific pedagogical decisions made by individual tutors during sessions. All tutors are DBS checked and hold Qualified Teacher Status (QTS) or equivalent.

8. Payments and Subscriptions

Lumira may offer subscription-based or pay-per-session access. By purchasing, you agree to:

  • Pay all applicable fees and taxes.
  • Allow automatic renewal of subscriptions unless cancelled before the renewal date.
  • Acknowledge that all payments are non-refundable unless required by law.

Pricing may change over time. You will be notified of material changes in advance.

9. Refunds and Cancellation

Refunds are not provided except where required by applicable consumer protection laws or in the event of material non-performance by Lumira. Session cancellations must be made at least 24 hours in advance.

10. Service Availability

We strive to ensure uninterrupted access to the Platform but do not guarantee availability. We may suspend or restrict access for maintenance, security updates, or legal compliance.

11. Third-Party Content and Links

The Platform may contain links to third-party websites or display third-party content, including Zoom for video sessions. Lumira is not responsible for the content, accuracy, or policies of third-party services. Your use of third-party services is at your own risk.

12. Privacy and Data Protection

Your privacy is important to us. Our data handling practices are described in our Privacy Policy, which forms part of these Terms. We comply with the UK GDPR, the Data Protection Act 2018, and other applicable UK and EU privacy laws.

13. Cookies and Tracking

We use cookies and similar tracking technologies to personalise content, analyse traffic, and improve our services. By using the Platform, you consent to the use of such technologies.

14. Safeguarding

Lumira takes safeguarding seriously. All tutors are DBS checked and trained in safeguarding. If you have any safeguarding concerns, please contact us immediately at info@lumiralearning.com.

15. Indemnification

You agree to indemnify and hold harmless Faculti Media Limited, its officers, directors, employees, partners, licensors, and agents from and against all claims, liabilities, losses, damages, costs, and expenses arising from your use of the Platform, your violation of these Terms, or your infringement of any intellectual property or privacy rights.

16. Disclaimers

To the fullest extent permitted by law: we do not warrant that the Platform will be error-free, uninterrupted, or free of viruses. Content is provided "as is" and "as available" without any warranties of any kind. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

17. Limitation of Liability

To the maximum extent permitted by law, Faculti Media Limited shall not be liable for any indirect or consequential losses; loss of revenue, profit, business, or goodwill; loss or corruption of data; or personal injury or death arising from your use of the Platform.

18. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes by email or via the Platform. Continued use after updates indicates acceptance of the new Terms.

19. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Faculti Media Limited (trading as Lumira) concerning the use of the Platform and supersede any prior agreements.
